Common questions about residential conveyancing

How long does conveyancing take?

As a general rule, most residential sales and purchases can be completed in around 8-12 weeks. However, this will depend on the type of property, how quickly the other party’s solicitors respond to any queries and whether there are any issues that need to be resolved e.g. questions over the property title.

We will always aim to keep your conveyancing moving ahead as quickly as possible by making sure every detail is accounted for and taking proactive action to head off any potential problems that could hold things up. What does a solicitor do during conveyancing?

The conveyancer’s role is to handle the legal side of the transaction, check for any potential problems and keep you and your money safe, while making sure the transaction can go ahead on schedule with as little stress as possible for you.

Exactly what your solicitor does during conveyancing will depend on the type of transaction, but for residential purchases they will typically:

  • Review the contracts of sale and title
  • Query any points of concern with the seller’s solicitor
  • Carry out conveyancing checks to identify any potential issues that might affect the property e.g. new developments in the local area
  • Exchange contracts with the seller’s solicitor
  • Transfer the deposit and balance of funds to the seller
  • Pay any Stamp Duty Land Tax (SDLT) due on the property
  • Update the property records with the Land Registry

When does the sale of a house become final?

The sale of a property only becomes legally binding when you exchange contracts. After this point, neither party has the right to pull out or try to renegotiate.

However, until you exchange contracts, either buyer or seller can pull out at any time for any reason. For sellers, this allows you to stay open to higher offers, while as a buyer it means that if any problems are discovered during conveyancing you can decide whether you want to go ahead with the purchase or potentially ask for a reduction in the sale price.
